General Terms and Conditions of Sale (G.T.C) – AvenueMac
By placing an order and accepting these terms, you agree that the following general conditions govern your purchase of parts and repair tools for the repair of computers and other electronic products from AvenueMac.
AvenueMac, located at 78 Avenue des Champs-Élysées, Office 562, 75008 Paris, FRANCE, can be reached by phone at +33 1 84 80 09 38 or by email at contact@avenue-mac.com.
These common terms are identified below and will have the following meanings:
“Business customer” refers to a person who purchases one or more products from AvenueMac as part of their commercial, industrial, craft, or professional activity, whether acting personally or through another person acting on behalf of or for the benefit of the business.
“Consumer customer” refers to a person who purchases one or more products from AvenueMac and is not a business customer.
“AvenueMac product” refers to new parts or refurbished parts (“Refurbished Parts”). Refurbished Parts have been tested and have met AvenueMac’s functional requirements. Therefore, Refurbished Parts are equivalent to new parts in terms of performance and reliability.
“AvenueMac Tools” refers to the tools, equipment, and related materials purchased from our store for the purpose of performing a repair on a device.
1. USE OF AVENUEMAC PRODUCTS
You are purchasing one or more Products from AvenueMac for use in repairing a specific computer (referred to as the “repaired computer”). In addition, AvenueMac may provide you with tools for rental purposes. The general conditions of such rental are defined in the rental terms and conditions found below.
You agree to use AvenueMac Products to repair the repaired computer in a manner consistent with these general conditions. If you are a Consumer Customer, AvenueMac Products are intended to be used solely for the repair for which they were purchased and may not be resold or transferred in any other way. For certain products, AvenueMac recommends the use of additional equipment and/or tools (such as gloves and tweezers).
Before performing any repair, you acknowledge and agree that: (1) you will have reviewed, familiarized yourself with, and understood all maintenance documentation related to any repair to be performed on each computer, including but not limited to process steps, tools, and materials required for the repair; (2) you will have access to the necessary tools, materials, and workspace for the repair; (3) you are comfortable with and capable of performing the repair; and (4) you may lose some or all functionality of your device during the repair, including during any necessary system configuration after the repair.
2. DATA LOSS
We understand that user data (including photos, contacts, and files of all types) is valuable. Data loss during repair is always possible, and in some cases, data may be erased or be unrecoverable. You agree that it is your sole responsibility to back up all existing data, software, and/or programs on your computer before performing a repair. AvenueMac will not be responsible for: (1) any loss, recovery, or compromise of data, software, or programs; (2) any inability to use your computer resulting from a repair performed using an AvenueMac product; or (3) any form of temporary or permanent damage to your computer resulting from a repair performed using an AvenueMac product, unless such loss or damage is caused by a defective AvenueMac product.
3. ORDERING, ORDER ACKNOWLEDGMENT, AND ORDER ACCEPTANCE
To order products from the AvenueMac store, you may visit the Store website at https://avenue-mac.com/. Then simply add the products you want to your cart, place your order (using the payment method of your choice), and have your items shipped to yourself or to a person designated by you.
You will have the opportunity to review your order— including product details, price, and shipping fees— before submitting it. Once you have placed your order, we will provide you with an online order number.
After receiving your order, we will send you a confirmation email, in most cases within one business day. The order confirmation email does not mean that we accept your order; it simply confirms that we have received it. Once we have processed your order and prepared it for shipment, we will send you an email indicating that we have accepted your order, which will include shipping details (“the shipping notification email”). We reserve the right to decline your order before sending the shipping notification email, particularly if the requested product is unavailable. We will inform you of the reason for this refusal and will not charge you for the order. To ensure product availability, we do not accept your order until we have prepared your product for shipment. In most cases, the processing time is one week for items in stock. For items not in stock, you will receive the shipping notification email when the item becomes available and ready to ship, but in all cases no later than the estimated delivery time provided at checkout. Once we have sent the shipping notification email and you have received it, a contract is formed between AvenueMac and you. Order information will be processed in accordance with our privacy policy, available below.
The shipping notification email will specify the price of the AvenueMac Product(s). All listed prices include value-added tax (“VAT”). If the VAT rate changes between the order confirmation email and the shipping notification email, we will adjust the VAT rate you pay, unless you have already paid the full amount before the VAT rate change took effect.
4. SHIPPING AND DELIVERY
Shipping fees may or may not apply depending on the destination. Orders containing multiple items will be shipped together once all products are in stock, and no later than 7 days from the day following the shipping notification email.
When AvenueMac handles the shipping of products you purchase from the store, the risk of loss or damage to AvenueMac Products transfers to you when you, or a person designated by you, physically take possession of the AvenueMac Products. Ownership of the AvenueMac Products transfers to you when you, or a person designated by you, physically take possession of the AvenueMac Products. If you encounter any delivery issues, contact AvenueMac to find a solution.
5. SAFETY AND DISPOSAL OF LITHIUM-ION BATTERIES
Battery safety is a very important concern when repairing a device with an integrated lithium-ion battery. Improper use or mishandling of lithium-ion batteries can result in fire, injury, or death. For your safety, if you are not comfortable performing battery replacements or other repairs, seek help from a technician with the necessary knowledge and experience. Improper battery replacement, incorrect handling of parts, or failure to follow instructions can also result in data loss or damage to your device, its parts, or your other property. Review all battery safety instructions in the manufacturer’s maintenance documentation and follow the workspace and handling guidelines before beginning a repair. If the battery is dented, punctured, or otherwise damaged, or if it cannot be removed from the device, stop the repair, consult the battery safety instructions in the manufacturer’s documentation, reassemble the device, and stop using it.
Lithium-ion batteries are hazardous waste. Used lithium-ion batteries must be disposed of separately from household waste and in accordance with local environmental laws and regulations, for example by bringing them to a designated collection point set by local authorities.
6. RIGHT OF WITHDRAWAL AND RETURNS
You have the right to cancel your order and return an AvenueMac product for any reason, or without providing a reason, within 30 days from the day you, or a person designated by you, took physical possession of the AvenueMac product.
You may cancel your order at any time after receiving the order confirmation email, but before receiving the shipping notification email. Once you have received the shipping notification email, you must follow the return procedure described below.
Returns must be made within 30 days from the day you, or a person designated by you, took possession of the AvenueMac product in accordance with Article 4 above (the “Return Period”). AvenueMac only accepts returns of products purchased from the store that are returned in new, unused, unaltered condition and in their original packaging. To initiate a return, contact us at any time during the Return Period to inform us of your intention to return or cancel the order.
Please note that tools that have been used are not eligible for return. This exclusion applies from the moment the tools are used.
You can inform us of your intention to cancel your order or return a product by filling out the request form available [here].
Once you have informed us of your intention to return the AvenueMac product, send it back to us with the return slip, original packaging, and included accessories (if any). You have an additional 14 days after notifying us to send back the AvenueMac Product(s). If the returned AvenueMac product is damaged, we may deduct the reduced value of the AvenueMac product from your refund amount.
All returned AvenueMac Products are subject to our inspection and approval before a refund is issued. For any AvenueMac product returned that we agree to refund under these conditions, we will issue a refund equal to the original purchase price and applicable taxes paid for the returned AvenueMac product and shipping fees (except for premium shipping fees exceeding the basic delivery option offered at purchase) to the original payment method used for the purchase. Payment will be made no later than 14 days from our receipt of the returned AvenueMac product or, if earlier, 14 days from receiving proof from you that you sent back the returned AvenueMac Products. The time for the refund to appear in your account varies depending on the payment method used and the credit card issuer. Except in cases where the AvenueMac product is incorrect or defective, return shipping costs are your responsibility.
If you receive an AvenueMac product you did not order or if an AvenueMac product is missing from your order, contact AvenueMac as soon as possible after receiving the shipment and we will assist you in resolving the issue. Describe the incorrect or missing AvenueMac Product(s) and attach photos if possible.
Once you have received the AvenueMac Product(s), we ask you to:

check as soon as possible that the AvenueMac Product(s) show no visible signs of shipping damage; and

if you discover visible signs of shipping damage, notify AvenueMac promptly within a reasonable timeframe.
Nothing in this return policy affects your rights or remedies under legal warranties, applicable manufacturer warranties, or commercial warranties, including the rights you have to return defective products during the AvenueMac Limited Warranty period for AvenueMac Products (French commercial warranty).
7. AVENUEMAC LIMITED WARRANTY
AvenueMac Products are covered by the French commercial warranty which, subject to certain limitations and exceptions described therein, provides remedies for AvenueMac Products showing defects in materials or workmanship during the warranty period (which, for used products, is 180 days from the initial retail purchase date, and for new products, is 1 year from the initial retail purchase date). If you are a Consumer Customer, you may also be entitled to repair or replacement under consumer law outside the warranty period. Damage caused to the repaired computer by your repair is not covered by AvenueMac’s standard hardware warranty for the repaired computer or by any other warranty. Such damage may be subject to out-of-warranty repair fees or render the repaired computer ineligible for repair. AvenueMac does not provide technical support for repairs.
8. CONSUMER RIGHTS
If you are a Consumer Customer, the AvenueMac Limited Warranty (French commercial warranty) is separate from and supplementary to the legal warranties provided by French consumer law, and you may have free recourse against AvenueMac in the event of non-conformity in addition to the AvenueMac Limited Warranty for AvenueMac Products (French commercial warranty). AvenueMac may process data relating to any consumer claim in accordance with its privacy policy.
Consumer customers benefit, in all cases, from the legal warranty of conformity and the legal warranty against hidden defects under French consumer law. To exercise your consumer rights, contact us using the details provided at the beginning of these terms.
9. PAYMENTS
Payments for AvenueMac products may be made by credit card or by bank transfer.
We reserve the right to verify the identity of the cardholder. To ensure that your credit or debit card is not being used without your consent, we will validate the name, address, and other personal information you provide during the order process against information held by the card issuer and the payment processor. By accepting these general terms and conditions, you consent to such verification checks being carried out. All cardholder information is secured through a payment gateway, and credit card information is not stored on AvenueMac’s website.
If you pay by credit card, when you place your order, we may block an amount equivalent to the total order amount on your credit card. If we do not receive authorization from your credit card issuer, we will notify you so that you can provide another payment method. Your credit card will be charged as soon as we accept your order.
10. BUSINESS PURCHASES
If you are a Business Customer, you will not benefit from the legal consumer rights provided under French law.
If you are a Business Customer, except for liabilities arising from our deliberate misconduct or gross negligence and liabilities that cannot legally be limited, our total liability to you will not exceed the total cost of your order.
11. GENERAL
If a court determines that any provision of these terms is unlawful, the other provisions will remain in force.
The laws of the country where you ordered the service or product govern this contract, unless otherwise stated below.
For customers who are not considered consumers, these terms are governed by and interpreted in accordance with the laws of France, and all claims must be brought before French courts.
Consumer information on online dispute resolution (in accordance with Regulation (EU) No. 524/2013): If you are a consumer and have entered into this contract with AvenueMac, you may use an online alternative dispute resolution procedure. The European Commission has set up an online dispute resolution platform, available at http://ec.europa.eu/consumers/odr/.
Consumer information on alternative dispute resolution for customers: AvenueMac is not obliged and does not intend to engage in any alternative dispute resolution process.
These terms constitute the entire agreement between you and us. These terms may only be amended if both you and we agree in writing. If you do not comply with these terms and we do not act immediately, this does not prevent us from taking action against you later and does not mean that we accept or agree that you are not required to comply with these terms.

Commercial Warranty Contract – AvenueMac Warranty
For AvenueMac parts and for tools purchased in France solely from the AvenueMac store. This Warranty does not affect or limit your right to cancel your order or return an AvenueMac product in accordance with the French general terms and conditions of AvenueMac.
IMPORTANT: BY USING AN AVENUEMAC PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THE AVENUEMAC LIMITED WARRANTY (THE “WARRANTY”).
PLEASE READ THIS WARRANTY CAREFULLY; IT INCLUDES CERTAIN LIMITATIONS AND EXCEPTIONS, AS WELL AS INSTRUCTIONS ON HOW TO SUBMIT A WARRANTY CLAIM (“CLAIM”).
THIS WARRANTY DOES NOT APPLY TO THE AVENUEMAC PRODUCT YOU ARE ATTEMPTING TO REPAIR (THE “REPAIRED AVENUEMAC PRODUCT”), BUT ONLY TO THE AVENUEMAC PRODUCT USED TO PERFORM THE REPAIR. FURTHERMORE, AVENUEMAC DOES NOT PROVIDE TECHNICAL SUPPORT FOR PRODUCTS OR THEIR USE IN REPAIRS.
APPLICATION OF CONSUMER LAW UNDER THIS WARRANTY
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND IS DISTINCT FROM AND SUPPLEMENTARY TO THE CONSUMER RIGHTS PROVIDED UNDER FRENCH CONSUMER LAW. THIS WARRANTY DOES NOT AFFECT YOUR RIGHTS UNDER FRENCH CONSUMER LAW. AVENUEMAC DOES NOT EXCLUDE, LIMIT, OR SUSPEND ANY OTHER RIGHTS YOU MAY HAVE UNDER FRENCH CONSUMER LAW, INCLUDING THOSE ARISING FROM NON-CONFORMITY OF A SALES CONTRACT.
In accordance with AvenueMac’s general terms and conditions, consumers benefit from the legal warranty of conformity and the legal warranty against hidden defects under French consumer law. This Warranty is without prejudice to these legal rights.

For the purposes of the disclaimer below, the term “consumer” means “you,” and the terms “professional” or “seller” mean “the entity selling under the French general terms and conditions of AvenueMac.”
The consumer has a period which, for used products, is 180 days from the initial retail purchase date, and for new products, is 1 year from the initial retail purchase date, to obtain enforcement of the legal warranty of conformity if a conformity defect appears. During this period, the consumer is only required to establish the existence of the defect, and not the date on which it appeared.
When the sales contract provides for the provision of digital content or a digital service on a continuous basis for a period greater than two years, the legal warranty applies to this digital content or service for the entire provision period. During this period, the consumer is only required to establish the existence of the conformity defect affecting the digital content or service, and not the date on which it appeared.
The legal warranty of conformity requires the seller, where applicable, to provide all updates necessary to maintain the conformity of the good.
The legal warranty of conformity gives the consumer the right to repair or replacement of the good within thirty days following the request, at no cost and without major inconvenience to the consumer.
If the good is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty period.
If the consumer requests repair but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the good.
The consumer may obtain a price reduction while keeping the good, or terminate the contract with a full refund against return of the good, if:
1° The professional refuses to repair or replace the good;
2° Repair or replacement occurs after a period of thirty days;
3° Repair or replacement causes major inconvenience to the consumer, particularly if the consumer permanently bears the costs of returning or removing the non-conforming good, or bears the installation costs of the repaired or replacement good;
4° The non-conformity persists despite an unsuccessful attempt by the seller to bring the good into conformity.
The consumer also has the right to a price reduction or contract termination when the conformity defect is so serious that immediate price reduction or termination is justified. In such cases, the consumer is not required to request repair or replacement beforehand.
The consumer is not entitled to termination of the sale if the defect is minor.
Any immobilization period of the good for repair or replacement suspends the warranty period remaining until the repaired good is delivered back to the consumer.
The above rights result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller acting in bad faith to hinder the implementation of the legal warranty of conformity may face a civil fine of up to €300,000, which may be increased to up to 10% of the average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the good is retained, or a full refund upon return of the good.
WHAT DOES THIS WARRANTY COVER AND WHAT IS ITS DURATION?
AvenueMac warrants that the product is free from defects in materials and workmanship when properly installed and used normally, in accordance with the manufacturer’s published guidelines, for the applicable Warranty Period specified below:

AvenueMac’s published guidelines include, without limitation, information contained in technical specifications, user manuals, and service communications. An AvenueMac Product that exhibits material or workmanship defects and is covered by this Warranty is referred to as a “Defective Product.”
Any replacement AvenueMac Product provided to you under this Warranty is warranted for the remaining duration of the original AvenueMac Product warranty, or for thirty (30) days from the date of delivery, whichever is longer, or for any additional period required by applicable law.
This Warranty applies only to the original purchaser who purchased the AvenueMac Product from Avenue-Mac.com and is transferable or applicable only to any subsequent consumer who acquired the covered product from another consumer, in accordance with Article L217-29 of the French Consumer Code.
WHAT DOES THIS WARRANTY COVER?
AvenueMac parts: AvenueMac warrants that the AvenueMac Part is free from defects in materials and workmanship when properly installed and normally used in accordance with the manufacturer’s published guidelines.
WHAT DOES THIS WARRANTY NOT COVER?
This Warranty does not apply to the following, and AvenueMac will not be responsible under this Warranty for:
any damage caused by the use of the AvenueMac Product to attempt or perform a repair;
any damage caused by the use of a third-party component or product that does not comply with the manufacturer’s published specifications;
any AvenueMac Product that has been repaired or modified to alter its functionality or capability without AvenueMac’s written authorization;
consumable parts, such as adhesives, unless the failure results from defects in materials or workmanship;
any AvenueMac Product that has been subject to misuse, negligence, alteration, modification, or any other internal or external damage;
any AvenueMac Product subjected to improper storage, transport, installation, operation, handling, or use, including use under conditions for which the product was not designed, use in an unsuitable environment, or use contrary to AvenueMac’s published guidelines or applicable laws or regulations; or
any defect caused by normal wear and tear or normal aging of the AvenueMac Product.
WHAT REMEDIES ARE AVAILABLE IN THE EVENT OF A WARRANTY BREACH?
If, during the Warranty Period of the relevant AvenueMac Product, you submit a Claim for a Defective Product in accordance with the “How to Make a Claim?” section of this Warranty, AvenueMac, through its Warranty Claims Administrator, and at its discretion:
will replace the Defective Product with a replacement product having the same characteristics as the original product. We reserve the right to use new and/or refurbished parts to replace the Defective Product, provided such parts have been tested and meet AvenueMac’s functional requirements; or
if no replacement product is available, will exchange the Defective Product for a refund of the purchase price.
If a replacement product is provided under this Warranty as described above, our Warranty Claims Administrator will charge you for the replacement product when it is shipped and will refund your payment for the Defective Product, minus any assessed damage, after its return and inspection by our Warranty Claims Administrator.
When an AvenueMac Product is replaced or refunded, any replacement item becomes your property, and the replaced or refunded item becomes the property of AvenueMac.
This Warranty also covers the return shipping costs for products subject to a Defective Product claim, as well as the shipping costs for replacement products for returned Defective Products, using a carrier and method chosen by AvenueMac, to locations within France.
Any AvenueMac product returned without a valid claim may be rejected and returned to you at your expense (subject to prepayment), or disposed of at AvenueMac’s sole discretion without further liability or obligation to you if you do not prepay return shipping costs within thirty (30) days after being notified that your warranty claim was denied.
HOW TO MAKE A CLAIM?
To submit a claim under this Warranty (a “Claim”), please follow these steps:
Initiate your return request through the dedicated link on our website.
All Defective Products must be returned with the following information:
A return slip showing the order number and reason for return, identifying the item and the purchaser (for example, an order confirmation email or shipping notification email).
The shipping address for the replacement AvenueMac Product.
All authorized Defective Products must be returned in the original shipping packaging or other packaging that protects the returned product equally well.
The returned Defective Product must not have been disassembled or modified without the prior written authorization of AvenueMac or our Warranty Claims Administrator.
LIMITATION OF LIABILITY
TO THE EXTENT THAT YOU ARE NOT A CONSUMER AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT AS PROVIDED IN THIS WARRANTY, AVENUEMAC IS NOT LIABLE FOR LOSS OF REVENUE, LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS), LOSS OF BUSINESS, LOSS OF GOODWILL, LOSS OF REPUTATION, OR LOSS, DAMAGE, COMPROMISE OR CORRUPTION OF DATA; COSTS OF RECOVERY, PROGRAMMING, OR REPRODUCTION OF ANY PROGRAM OR DATA STORED IN THE REPAIRED DEVICE OR USED WITH IT, OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE AVENUEMAC PRODUCT OR THE REPAIRED DEVICE.
THE ABOVE LIMITATION DOES NOT APPLY TO CLAIMS FOR DEATH OR PERSONAL INJURY, CLAIMS RELATING TO DEFECTIVE PRODUCTS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL ACTS AND/OR GROSS NEGLIGENCE.
AVENUEMAC DISCLAIMS ALL LIABILITY FOR ANY POTENTIAL LOSS OF INFORMATION STORED IN THE DEVICE OR REPAIRED PRODUCT.
GENERAL
No reseller, agent, or employee of AvenueMac is authorized to make any modification, extension, or addition to this Warranty. If any provision is found to be unlawful or unenforceable, the legality or enforceability of the remaining provisions shall not be affected or impaired. This Warranty is governed by and interpreted in accordance with French law.
AvenueMac, or its successor, is the warrantor under this Warranty.
AvenueMac General Rental Terms and Conditions
1. Contract Overview
This rental agreement establishes that you, as the renter, agree to rent the equipment and materials specified in your rental confirmation, offered by AvenueMac, located at 78 Avenue des Champs-Élysées in Paris, France.
2. Rental Period
The rental period, defined as the "Rental Period," is a period of seven (7) calendar days. This period begins on the date of receipt of the rented equipment, or is deemed to have begun if Article 7 applies. If the last day of this period falls on a weekend or a public holiday, it is extended to the next business day.
3. Rental Terms
1. You are responsible for any loss, damage, or theft of the rented equipment until it is returned to AvenueMac or a carrier designated by us. If the equipment is not returned at the end of the rental period, you will be charged for replacement (including handling fees) or for any necessary repairs, unless the cost of repairs exceeds the replacement value.
2. Any amount due may be charged to your payment method. The amount for unreturned items will be the amount confirmed when you placed your order. For damaged items, the cost will be determined and communicated later. If payment fails, you will still be liable for this amount, and we will contact you to arrange a new payment.
3. Failure to pay an amount due after a reminder may result in collection proceedings initiated by us.
4. In the event of loss, theft, or damage to the equipment, AvenueMac reserves the right to refuse any future rentals.
4. Payment
In addition to the rental cost, an amount may be held on your payment method to cover any potential repair or replacement costs. The exact amount will be confirmed when you place your order. This amount will not be charged if the equipment is returned in good condition and on time. However, the hold authorization may limit your access to these funds while it is active. If the repair or replacement costs cannot be covered by this hold, they will be deducted from the payment method provided.
5. Delivery and Return
- We will arrange delivery of the rented equipment. Upon receipt, please:
- Immediately inspect the equipment for any shipping damage.
- Promptly report any visible shipping damage to AvenueMac.
- Specific return instructions will be provided. Following these instructions is crucial to prevent damage during return shipping. You will be responsible for arranging and packaging the equipment for return, according to our instructions, via a carrier approved by AvenueMac.
- By accepting this service, you explicitly consent to AvenueMac initiating the provision of the service and acknowledge that once the service has started, you cannot cancel your order or exercise a right of withdrawal.
AvenueMac General Terms of Service
General Terms of Service
Article 1: General Provisions
1.1 The Company
The company AVENUEMAC is a simplified joint-stock company with a share capital of €10,000, registered with the Paris Trade and Companies Register under number 883 875 338, with its registered office at Bureau 562 – 78 avenue des Champs-Élysées – 75008 PARIS.
1.2 Purpose of the Repair Service
AVENUEMAC specializes in computer equipment repair, which it carries out through its own technicians.
AvenueMac operates exclusively in its workshop located at:
7 Rue du Bigarreau, 68260 Kingersheim. Collection of the faulty device can be arranged by courier throughout France.
1.3 General Terms of Service
These General Terms of Service, hereinafter referred to as "General Terms," are established by AVENUEMAC.
They define the general contractual terms applicable between AVENUEMAC and its client, within the scope of its repair services.
The Client declares having read and accepted them before confirming any service request.
1.4 Modification of these General Terms
AVENUEMAC reserves the right to modify these General Terms at any time, particularly to comply with regulatory changes.
Article 2: Description of Repair and Setup Services
2.1 Repair
For device repair, AVENUEMAC will provide a quote that the client must approve before any intervention by a technician.
We offer a simple flat-rate pricing system, allowing the client to know the initial amount due:
Single flat rate including:
• Labor required to repair the faulty device (excluding parts)
up to 1 hour.
• Additionally:
o A detailed quote for the repair including parts
o Every additional 15 minutes will be charged
All our services are covered by a 3-month warranty.
If, during the intervention, our technician determines the device is technically irreparable, or if the client refuses the quote issued by AVENUEMAC, the flat fee paid as a deposit will remain fully due. In such cases, AVENUEMAC will not issue any refund.
Article 3: Consumer Protection / Right of Withdrawal
3.1 Reminder of Legal Provisions
The provisions of Article L.121-20 of the French Consumer Code are expressly recalled.

Each request can be individually cancelled.

Article 4: Pricing and Payment
4.1 Pricing
The prices of flat-rate services are listed on www.avenue-mac.com. Prices are in euros, including VAT, and are subject to change without notice.
Any time exceeding the one-hour flat-rate slot will be charged at €49.90 incl. VAT.
All payments made by clients are non-refundable, even if future offers become more favorable.
4.2 Payment Methods
Payment is made directly to the technician after the intervention, either by card (Visa, CB, Mastercard) on-site or online via a secure payment link.
Article 5: Liability Waiver and Force Majeure
Under Article L.121-20-3 of the Consumer Code, AVENUEMAC shall not be liable for service failures due to the client, unforeseen third-party issues, or force majeure.
Article 6: Partial Invalidity
If one or more clauses of the contract are deemed invalid or unenforceable, this does not affect the validity of the rest of the General Terms.
Article 7: Complaints
All complaints must be addressed to AVENUEMAC Customer Service via email with delivery receipt to: contact@avenue-mac.com or by registered mail to the company's registered office.
Article 8: Mediation
Under Article R.612-1 of the Consumer Code, the client may contact the Consumer Mediation entity free of charge: Société Médiation Professionnelle – www.mediateur-consommation-smp.fr – 24 rue Albert de Mun – 33000 Bordeaux, for any unresolved claims made to AVENUEMAC Customer Service within the past year.
Article 9: Applicable Law and Jurisdiction
These General Terms are governed by French law.
Any disputes shall be under the exclusive jurisdiction of the Paris Court of Appeal, where legally permitted, even in the case of multiple defendants or third-party claims.
Article 10: Device Shipping and Transport
10.1 Home Pickup by Courier
For remote services, AVENUEMAC offers pickup of the faulty device at the client’s chosen address. A courier appointed by AVENUEMAC performs this collection.
The client is responsible for secure packaging of the device before collection. The device must be properly protected in a suitable package, ready for shipping when the courier arrives. No accessories (cables, power adapters, covers, keyboards, etc.) should be included unless specifically requested by our technical team. AVENUEMAC is not liable for any unreported accessories lost or damaged during transport.
10.2 Transport Insurance Conditions
The transport service includes insurance up to €45 by default, included in the collection service fee.
If the client wishes to insure the device for a higher amount, two optional insurance levels are available:

Insurance up to €2,000: €148 excl. VAT surcharge
Any request for additional insurance must be made explicitly by the client before the device is picked up. Once the package has been handed over to the courier, no changes to the insurance can be made.
10.3 Responsibility During Transport
AVENUEMAC cannot be held liable for any loss, theft, or damage occurring during transport, beyond the limits of the confirmed insurance coverage selected before shipment.
